Withdrawal from the contract

If

A) you are a consumer

or

B) you are a natural person, and the contract you concluded with us after December 31, 2020 is directly related to your business activity, but is not of a professional nature for you

- as a rule, you have the right to withdraw from a distance contract.

You can withdraw from the contract by submitting a declaration of withdrawal to us, e.g., via email to: sklep@medimall.pl

Return the returned item to us immediately to the following address: Hamed (Medimall.pl), ul. Kineskopowa 1 (Building D), 05-500 Piaseczno, but no later than 14 days from the date on which you withdrew from the contract.

You may withdraw from the contract within 14 days.

The fourteen-day withdrawal period begins:

• for a contract in which we deliver an item and are obligated to transfer ownership of it - from the moment you or a third party other than the carrier designated by you take possession of the item, and in the case of a contract covering multiple items that are delivered separately, in batches, or in parts - from the moment you or a third party other than the carrier designated by you take possession of the last item, batch, or part.

To meet the deadline, it is sufficient to send the declaration before its expiry.

We will refund your payments, including the costs of delivering the goods as specified in the regulations, immediately, but no later than 14 days from the date of receiving your declaration of withdrawal from the contract.

We may withhold the refund of the payment received from you until we receive the goods back or you provide proof of having sent them back, whichever comes first.

Remember that you do not have the right to withdraw from a distance contract in the following cases: in relation to the contract:

• where the subject of the service is a non-prefabricated item, manufactured according to your specifications or intended to meet your individual needs;
• where the subject of the service is an item that spoils quickly or has a short shelf life;
• where the subject of the service is an item delivered in a sealed package, which cannot be returned after opening the package due to health protection or hygiene reasons, if the package was opened after delivery;
• where the subject of the service is audio or visual recordings or computer programs delivered in a sealed package, if the package was opened after delivery.

Complaints

If the goods purchased from us prove to be defective, you have the right to make a complaint based on the warranty. It is best to submit a complaint to the following email address: sklep@medimall.pl or by post to ul. Migdałowa 31, 02-796 Warsaw.

If you are not a consumer, we are liable to you, within the limits permitted by law, only up to the amount of your order, within one year of delivery of the goods. The following provisions apply to consumers.

The defective goods should be sent to the following address: Hamed (Medimall.pl), ul. Kineskowa 1 (Building D), 05-500 Piaseczno

In connection with the defect, you may request:

• replace the item with a defect-free one,
• remove the defect,

or submit a declaration of:

• reduction of the price,
• withdrawal from the contract – in the case of a significant defect.

We are liable to you for defects discovered within two years from the date of delivery of the item – under the terms of the Civil Code.

Your complaint will be considered (addressed) within 14 days of the date we receive your complaint.
